Article 1 (Purpose)
These Terms of Use aim to regulate the rights, obligations, and responsibilities between the Cellology shopping website (hereinafter referred to as the "Website"), operated by DERMAHK Co., Ltd. (hereinafter referred to as the "Company"), and its users when using the online services (hereinafter referred to as the "Services," which are accessible regardless of the type of terminal device used).
※ These Terms of Use apply to electronic commerce transactions conducted via PC communications, wireless devices, and other means.
Article 2 (Definitions)
- "Website" refers to the virtual business establishment set up by the Company using information and communication facilities such as computers to trade goods or services (hereinafter referred to as "Goods, etc.") and may also refer to the operator of the shopping website.
- "User" refers to any member or non-member who accesses the Website and uses the Services provided by the Company in accordance with these Terms of Use.
- "Member" refers to a user who has completed the membership registration process and may continuously use the Services.
- "Non-member" refers to a user who uses the Services without registering as a member.
Article 3 (Display, Explanation, and Modification of Terms)
- The Website shall display the contents of these Terms of Use, the Company’s trade name, representative’s name, business address (including the address where consumer complaints can be resolved), telephone number, fax number, email address, business registration number, mail-order sales registration number, and personal data protection officer on the initial screen where users can easily notice them. However, the terms may be provided via a linked page for users to review.
- Before obtaining the user’s consent to these Terms of Use, the Website shall provide separate linked pages or pop-up windows for critical terms such as cancellation policies, delivery responsibilities, and return conditions to ensure users understand them.
- The Website may modify these Terms of Use within the scope permitted by relevant laws, including the E-Commerce Consumer Protection Act, Terms and Conditions Regulation Act, Basic Act on Electronic Documents and Electronic Transactions, Electronic Financial Transactions Act, Digital Signature Act, Information and Communications Network Act, Door-to-Door Sales Act, and Framework Act on Consumers.
- If the Website modifies the Terms of Use, it shall announce the effective date and reasons for the modification between 7 days before the effective date and the effective date itself. However, if the changes are unfavorable to users, a notice period of at least 30 days shall be provided to allow users to adapt.
- Modified terms apply only to contracts concluded after the effective date. Contracts concluded before the effective date remain subject to the previous terms. However, if a user requests to apply the modified terms during the notice period under Article 3 and the Website agrees, the modified terms shall apply.
- Matters not specified in these Terms and their interpretation shall follow the E-Commerce Consumer Protection Act, Terms and Conditions Regulation Act, guidelines set by the Fair Trade Commission, relevant laws, or commercial practices.
Article 4 (Provision and Modification of Services)
- The Website provides the following services:
- Information on goods or services and purchase agreements.
- Agreements related to the delivery of goods or services.
- Other services determined separately by the Website.
- If goods are out of stock or technical specifications change, the Website may modify the content of the goods or services to be provided and shall indicate the changes and the revised delivery date on the relevant product page.
- If the Website has already entered into a contract with a user to provide a specific service but must modify it due to stock shortages or technical changes, the Website shall notify the user of the reason at the contact address provided by the user.
- If such modifications cause damage to the user, the Website shall compensate for the loss. However, this does not apply if the Website proves no intentional or negligent fault.
Article 5 (Service Interruption)
- The Website may suspend Services for maintenance, replacement, malfunction, or communication disruptions.
- If service interruption under Paragraph 1 causes damage to users or third parties, the Website shall compensate for the loss unless it proves no intentional or negligent fault.
- If the Website cannot continue Services due to business termination, mergers, etc., it shall notify users via the method specified in Article 8 and compensate users under the original terms.
Article 6 (Member Registration)
- Users may apply for membership by completing the registration form and agreeing to these Terms.
- The Website shall accept membership applications unless:
- The applicant was previously disqualified under Article 7(3) (except after 3 years).
- The provided information is false, omitted, erroneous, or suspected of resale (e.g., repeated registrations under the same phone number).
- Technical difficulties prevent registration.
- Membership is established when the Website notifies the applicant of approval.
- Members must promptly update their registered information if changes occur.
Article 7 (Withdrawal and Termination of Membership)
- Members may request withdrawal at any time, and the Website shall process it immediately.
- The Website may restrict or suspend membership if:
- False information was provided during registration.
- The member fails to pay for purchases or other dues.
- The member disrupts e-commerce order (e.g., interfering with others’ use or stealing information).
- The member engages in illegal or unethical conduct (e.g., unauthorized resale of the Website’s products).
- If a restricted member repeats the violation or fails to rectify it within 30 days, the Website may terminate membership.
- Upon termination, the Website shall cancel the membership and notify the member, providing at least 30 days’ prior opportunity to explain.
Article 8 (Notices to Members)
- Notices shall be sent to the member’s registered email address.
- For general notices, the Website may post announcements for at least 7 days instead of individual notices. However, transaction-specific matters require individual notification.
Article 9 (Purchase Requests and Consent to Personal Data Provision)
- Users purchasing goods shall:
- Search and select goods.
- Enter the recipient’s name, address, phone number, and email (or mobile number).
- Confirm terms, cancellation restrictions, shipping/installation fees, etc.
- Agree to the terms (e.g., by clicking "Confirm").
- Confirm the purchase and agree to the Website’s terms.
- Select a payment method.
- If personal data is shared with third parties, the Website must disclose the recipient, purpose, items, retention period, and obtain consent (including for changes).
- If data processing is outsourced, the Website must disclose the contractor and scope. Exceptions apply for contract fulfillment or convenience improvements under the privacy policy.
Article 10 (Contract Formation)

A minor purchases goods prohibited by the Youth Protection Act (e.g., tobacco/alcohol).

Users may raise objections immediately after receiving the notice.
Article 11 (Payment Methods)
Payment may be made via:

Prepaid cards, e-money, or points.

Payment agreements with electronic financial institutions.

Gift certificates approved by the Website.

Article 12 (Order Confirmation, Changes, and Cancellations)
- The Website shall send an order confirmation after purchase requests.
- Users must request changes/cancellations immediately if the order is incorrect.
- The Website shall process requests before shipment. Post-shipment cancellations follow Article 15.
Article 13 (Goods Supply)
- Goods shall be delivered within 7 days after payment unless otherwise agreed.
- The Website shall specify delivery methods, responsible parties, and costs. Late deliveries may incur compensation unless the Website proves no fault.
Article 14 (Refunds)
If goods are unavailable, the Website shall notify users and process refunds within 3 business days.
Article 15 (Cancellations, Returns, and Exchanges)

Users may cancel or return goods within 7 days of receipt, except if:

The user caused damage/loss (beyond packaging inspection).

The user consumed/used the product, reducing its value.

Article 16 (Return Shipping Costs)
- Users generally bear return shipping costs unless the return is due to the Website’s fault (e.g., defects, mismatches).
- Refunds shall be processed within 3 business days. Delays incur interest per Fair Trade Commission rates.
- For credit card/e-money payments, the Website shall request payment cancellation.
- The Website must clearly state who bears cancellation costs.
Article 17 (Personal Data Protection)
- The Website collects minimal necessary user data and complies with laws. Required fields include:
- Name.
- Address.
- Phone number.
- Desired ID (members).
- Password (members).
- Email (or mobile number).
- Gender and birth date.
- Data shall not be shared with third parties without consent, except for:

- Payment processing.
- Identity verification.
- Legal requirements.
- Users may access, correct, or delete their data at any time.
- The privacy policy shall specify the data protection officer, purpose, recipients, and retention period.
- Other matters follow the Personal Information Protection Act.
Article 18 (Website’s Obligations)
- The Website shall comply with laws, public order, and morals, and strive to provide stable Services.
- It shall protect user data with security systems and ensure confidentiality.
- It shall compensate for damages caused by its faults.
- Unsolicited promotional emails/texts are prohibited.
Article 19 (User’s Obligations)
Users shall not:
- Provide false information.
- Use others’ identities.
- Unauthorizedly extract/modify Website data for profit.
- Disrupt Website operations.
- Upload viruses/malicious code.
- Violate laws or ethics.
- Share IDs/passwords with third parties.
- Fail to report unauthorized account use.
Article 20 (Intellectual Property)
- All Website content (text, images, trademarks, code, etc.) is owned by the Company or licensors and protected by law.
- Unauthorized use, reproduction, or distribution is prohibited.
- Users must report infringements.
Article 21 (Liability Limitation)
- The Website is not liable for damages caused by force majeure or user negligence.
- It excludes liability for indirect, incidental, or punitive damages.
- It does not guarantee uninterrupted or error-free Services.
- It is not responsible for transactions outside the Website or without proper initial/pop-up screens.
Article 22 (Service Changes, Suspension, and Termination)
- The Website may modify, suspend, or terminate Services for maintenance, upgrades, or emergencies (with notice, except emergencies).
- It may terminate access for violations and delete related data.
- Post-termination, user data shall be retained/deleted per laws.
Article 23 (Notices and Announcements)
- Notices may be sent via email, SMS, or Website announcements.
- Major announcements on the homepage are deemed delivered.
- Users are responsible for maintaining accurate contact details.
Article 24 (Governing Law and Jurisdiction)
- Disputes arising from or related to this Agreement shall generally be resolved by the court having jurisdiction over the user’s place of residence.
- However, if the user is a foreign resident living outside Korea, or if the user’s nationality is undefined, the dispute shall be submitted to the Seoul Central District Court as the court of first instance with exclusive jurisdiction.
Article 25 (Special Provisions)
- These Terms are the basic agreement. Additional terms for specific services ("Special Provisions") may apply if users agree.
- The Company may set detailed service policies and notify users.
Article 26 (Membership Eligibility and Loss)
- Membership is granted per Website policies.
- The Website may revoke membership for violations without consent.
Article 27 (Earning and Using Points)
- Points (miles) are awarded per Website policies.
- Points are non-refundable and usable only for designated goods.
- Point accrual/usage varies by product/service.
- Point policies may be revised with notice.
Article 28 (Point Cancellation)
- Withdrawn members forfeit all points (non-transferable).
- Points obtained illegally may be deleted without notice.
- Points expire at year-end unless used.
- Expiration notices are sent to registered emails (user’s responsibility if undelivered).
- The Website may reclaim unfairly used points.
Article 29 (Member Compliance)
- Members shall follow Website rules.
- IDs/passwords must not be shared.
- Commercial resale is prohibited.
- Confidential transaction details must not be disclosed.
- Members liable for damages caused intentionally/negligently.
Article 30 (Dormant Accounts)
- Inactive accounts may be restricted as "dormant." Reactivation requires a request.
- After a set period, dormant accounts may be terminated with notice.
Article 31 (Miscellaneous)
- If any term is invalid, the remainder remains effective.
- Unspecified matters follow laws and commercial practices.
